Experience

Sergei Voitovich has been a partner at Grischenko & Partners since 1993. He is the head of the arbitration practice of the firm. For a number of years, he has been an Associate Proffesor at the Kyiv University School of International Law, specializing in international economic law. In 1993-1994 Mr. Voitovich advised the Organization for Economic Cooperation and Development (OECD) on the investment laws of selected member states of the Commonwealth of Independent States.  In 1996, he was a legal intern at the London law firm of Dickson Minto W.S.  From 1997 to 2001, Mr. Voitovich was a member of the Chamber of Independent Experts on Foreign Investment at the President of Ukraine, where he participated in four panels as a panel member. Over a number of years Mr. Voitovich has been included in many international and domestic ratings of the best lawyers in various practices. In 2010 the international rating Best Lawyers named Sergei Voitovich as the Lawyer of the Year in Arbitration and Mediation in Ukraine.

Selected Representations

Mr. Voitovich has represented Ukraine as a counsel in several multi-million investment arbitration cases before the International Centre for the Settlement of Investment Disputes (ICSID), and in the investment disputes within the Energy Charter Treaty before the Arbitration Institute of the Stockholm Chamber of Commerce, and in the invesments dispute under the UNCITRAL rules.  In particular, he participated as a leading counsel in the teams of legal counsel of the Government of Ukraine which won the ICSID cases Generation Ukraine Inc. v. Ukraine (2000-2003) and Tokios Tokeles v. Ukraine (2003-2007), as well as the arbitration case AMTO v. Ukraine before the Arbitration Institute of the Stockholm Chamber of Commerce (2006-2008). Furthermore, Sergei Voitovich headed the teams of legal counsel of Ukraine in the ICSID cases of J. Lemire (1998-2000) and of the Western NIS Enterprise Fund (2004-2006), which were settled by the agreements of the parties, as well as Alpha Projektholding (2007-2010 in ICSID) and Remington (2009-2011 in Stockholm Arbitration Institute), in which the awarded amounts of  claimed damages were substantially reduced.

Publications

Mr. Voitovich is the author of a monograph entitled “International Economic Organizations in the International Legal Process” (Martinus Nijhoff, 1994). He also co-authored a legal treatise entitled “The International Centre for the Settlement of Investment Disputes (ICSID): Several Issues of Jurisdiction and Arbitration Procedure” (2005, in Russian). In all, he has contributed literary works to more than 70 professional publications.

Awards

In 2003, Mr. Voitovich was awarded by the Cabinet of Ministers of Ukraine for his contribution to Ukraine’s victory in the arbitration case Generation Ukraine at ICSID. In 2008, by the Edict of the President of Ukraine Mr. Voitovich was conferred the title of  “The Honoured Lawyer of Ukraine”.
