includes the defense of the rights of both Ukrainian and foreign persons and
legal entities in court and before arbitration tribunals.
Our lawyers have represented the interests of both Ukrainian and foreign
clients in judicial matters and arbitration cases before such international
arbitration institutions as the London Court of International Arbitration and
the Arbitration Institute of the Stockholm Chamber of Commerce.
Furthermore, we have successfully represented the Government of Ukraine in several multi-million arbitration disputes at the International Centre for the Settlement of Investment Disputes in Washington, DC. Our law firm acted as counsel to the Government in all four concluded ICSID cases against Ukraine with one of the best results in the world for this category of investment disputes – two won cases (the cases of Tokios Tokeles and Generation Ukraine, Inc., - jointly with law firm Proxen & Partners) and two settlements (Lemire and Western NIS Enterprise cases) without a monetary compensation by the respondent State.
In 2006 to 2008, Grischenko & Partners, jointly with Proxen & Partners, protected the interests of Ukraine in the arbitration case upon the claim of Latvian Company AMTO, which case was won by Ukraine in 2008 before the Arbitration Institute of the Stockholm Chamber of Commerce. This is the first victory of the respondent state in an investment dispute under the Energy Charter Treaty.
